These terms and conditions explain the rights and responsibilities of the client and The Hay Handyman

      1. The Hay Handyman will provide all client with a written estimate or quotation, which will include sufficient detail for the completion of the works. If any clarification is required, please contact us so that we can provide it. Extra works can be provided subject to a written confirmation including cost.
      2. A ‘contract’ with The Hay Handyman is an agreement by the client to have work undertaken based on a written estimate or quotation headed ‘Quote/Estimate’ submitted directly to the client on an official The Hay Handyman letterhead and is a clear and straightforward undertaking between the two parties to form a contract.
      3. Once an estimate or quotation has been accepted (either verbally or in writing) and the client has paid their deposit, if applied, then a contract has been entered into and these terms will come into effect. Estimates & Quotes are valid for the period outlined on the documentation.

        1. Once the client has entered into a contract with The Hay Handyman, by paying their deposit, if applicable, they have a 14 day cooling off period should they wish to cancel the contract. The client can cancel their contract within 14 days by either phone or email to The Hay Handyman. (07498227902 / thehayhandyman@gmail.com)
        2. Any dates of commencement and completion of works are offered in good faith and are based on the position at the date of order. These are not guaranteed and could be subject to delays because of strikes, weather, accidents, government direction, force majeure, mechanical breakdowns, unavailability of materials and parts or other causes beyond the Company’s control. The Hay Handyman will make all reasonable endeavours to start and complete work by the dates given but will not accept any liability for any delay or accept any form of liquid damages for any external works that are governed by atmospheric conditions and that are beyond reasonable control.
        3. All prices quoted are calculated on the basis of free access and unimpeded working during our normal working hours (9am – 5pm Mon – Fri) (Excluding bank holidays), unless otherwise agreed. Please note that we may be on site until 6pm or on a Saturday. We will get prior agreement with the client should this happen.
        4. All fees payable to The Hay Handyman will be invoiced depending on the agreed payment terms and/or the procurement of any associated materials, otherwise the following terms will apply:  Most projects under £1,000.00 will be invoiced on the successful completion of works and will be due 7 days from the date of invoice only.

      All projects in excess of £1,000.00 will be invoiced as follows:

         

         
            1. Project invoice will be raised on the commencement of works to cover part or the full costs of materials and access equipment, a percentage of the project invoice is dependent on the size of project and the frequency of material orders delivered to site.

            2.  Interim invoices will be raised every 14 days and to the value of works completed to date, this may also include any further material orders over and above the initial cost and not covered by the proforma invoice. These invoices will be due 7 days from the date of invoice only.
            3.  Final invoices will only be raised on the successful completion of works and will be due 7 days from invoice date only.

            1. It is the customer’s responsibility to arrange planning permission, building control and any utility changes (eg Welsh Water). If planning permission is required for the work, The Hay Handyman may request to see proof that this has been agreed prior to beginning work.

            2. The client will be responsible for ensuring that the site is safe for The Hay Handyman and, if applicable, its sub-contractors to carry out the works and that it contains no hazards or dangerous features which were not disclosed by the client or reasonably apparent to The Hay Handyman on inspection of the site prior to the issue of any proposals.

            1. Commencement of work is under the assumption of uninterrupted work for the duration of the contract and in accordance with planning permission where applicable. The Hay Handyman will not be held liable for any costs incurred as a result of delays due to unforeseen circumstances. (eg planning permission delays resulting in work having to stop)

            2. All and any materials being supplied by the client are readily available on site and without delay, on the exact date and time requested to ensure the commencement or continuation of works to programme.
            3. The Hay Handyman will agree all practical arrangements with regards to working methods with the client in order to provide minimum disruption to the client and allow work to be carried out efficiently by the contractor.
            4. Free access is required for delivery of building materials, plant, machinery, skips etc.
            5. The means of entry and exit to the working area, must be, as far as reasonably practicable, safe and without risks to health.
            6. Access to welfare facilities, on-site parking and available on-site services, such as mains electricity and a water supply to be used without charge, or the use of project and works related activities only.

            1. All used or removed materials on-site remain the property of The Hay Handyman  and will be disposed of accordingly.

            2. The Hay Handyman reserves the right to adjust the fees and the date of completion of the project in the event that the scope of works or any associated proposals are altered after the works are commissioned.
            3. The Hay Handyman may directly employ or sub contract labour to work on site. Each sub-contractor takes full responsibility for their own third party liability. The Hay Handyman will oversee all works to completion and takes full general and operational responsibility in the running of any contract agreed with the client.
            4. The Hay Handyman may provide a payment plan to the client prior to commencement of works. This will usually include a 5% deposit, staged payments and an end payment upon completion of works. Deposits are non-refundable and allow The Hay Handyman to book work in and agree a formal start date for works and purchase materials. Please note: In the very unlikely event that The Hay Handyman have to cancel your work, your deposit will be fully refunded.

            1. Payments must be made in a timely manner or work progress may be impeded or ceased (in the case of non-payment). Payments can be made by cash, credit card but bank transfer is our preferred method. All invoices include our bank details for bank transfers. Cheques presented without prior arrangement will be subject administration charge. We are unable to process cheques electronically and must be presented or sent to a branch for processing. All cheques processed in this manner will be subject to a £30 administration fee.

            2. Under the Late Payment of Commercial Debts (Interest) Act 1998 The Hay Handyman reserves the right to charge interest and compensation at the current statuary rate on any balance’s outstanding after the invoice due date and until the debt is settled in full.

            1. Insurance – Public Liability and Employers’ Liability: The Hay Handyman has Public Liability Insurance and Employers’ Liability to the sum of £2,000,000. All usual general building practices are covered within our insurance policy.

            1. All client information is retained in accordance with the Data Protection Act 1988 and all personal and other client details will remain confidential.

            1. Guarantees: All client will benefit from a full guarantee on our workmanship for a period of 12 months. Guarantees on materials run in accordance with manufacturer’s warranty periods where applicable. Our guarantee covers all new work and new materials used in construction or repairs, but does not guarantee the integrity of any existing structures, materials or decorations. In the event of a failure beyond the guarantee period we will be happy to investigate the cause and negotiate a solution to the problem without delay and carry out any agreed repairs as soon as possible. Charges may apply for remedial work carried out beyond guarantee dates or to items not covered by our guarantee. Please note: Decorations are signed off on completion and not covered by guarantee. Plastering work is not covered by our guarantee.

            1. damage caused by other trades outside of our control, we shall hold the client liable for the cost of any repair or replacement.

            1. No responsibility is taken by The Hay Handyman for the presence of perished or rotten timber (or any other perished or rotten materials) in existing structures such as doors, windows and frames whether detected or undetected at the time of contract.

            1. We will not be held responsible for the suitability of the existing boilers ability to provide for additional plumbing works. If the existing boiler is found to be unsuitable, this shall be discussed with the client and any parts required shall be supplied at trade cost. If we have to remove existing radiators for any reason (eg plastering) we will not be held responsible for their effectiveness once they are replaced.

            1. The Hay Handyman will endeavour to protect existing surfaces with the use of dustsheets and loose plastic sheeting etc along with care in our working practice. However, responsibility for protection from damage of any existing surface or fabrics etc is the responsibility of the client. Arrangement can be made to put in place protection of existing surfaces, over and above our basic cover, at a negotiated additional cost. We strongly recommend the clients moves any expensive or sentimental items before work commences. If we are required to move furniture to undertake our work we will not be held responsible for any breakages or stains that may occur. We advice clients to keep all valuables and expensive items safe and secure for the duration of the works, as we cannot be held liable for any theft or loss.

            1. Discounts and retentions: Prices are based on the understanding that no retentions are held unless previously arranged and authorised. No Main Contractor or Sub Contractor discounts are given unless agreed and confirmed in writing.

            1. We will endeavour to employ a helpful attitude at all times and will always attempt to bring the building works to a satisfactory conclusion as soon as possible taking into account weather conditions, availability of specialist materials and unforeseen circumstances etc.

            1. The Hay Handyman take pictures of the progress of our projects. We reserve the right to use these pictures in our portfolio of work, on our website and on various social media websites for marketing and information purposes. Please let us know via email at the start of your work if you are not happy with this.

          MDF

          MDF (medium-density fiberboard) is a type of engineered wood product that is made by binding wood fibers with synthetic resin under high pressure and heat. MDF dust can be dangerous to health when inhaled because it contains a mixture of wood dust, synthetic resin, and other chemicals used during the manufacturing process. Here are some reasons why MDF dust can be harmful:

          1. Respiratory problems: MDF dust can cause respiratory problems such as coughing, wheezing, and shortness of breath. Long-term exposure to MDF dust can also cause chronic bronchitis and other lung diseases.

          2. Irritation of the eyes, nose, and throat: MDF dust can irritate the eyes, nose, and throat, causing redness, itchiness, and soreness.

          3. Skin irritation: MDF dust can cause skin irritation and rashes, particularly in people who have sensitive skin.

          4. Carcinogenicity: MDF dust contains formaldehyde, a known human carcinogen. Formaldehyde is used as a binder in MDF and is released into the air as a gas when MDF is cut, sanded, or otherwise worked on.

          To minimize the risks associated with MDF dust exposure, it is recommended to wear appropriate personal protective equipment, such as a respirator, goggles, and gloves, when working with MDF. It is also important to work in a well-ventilated area and to avoid generating dust as much as possible by using dust collection systems or wet cutting methods.
